Insurance Law

The handling and settlement of insurance claims is part of everyday business life. We actively advise and support our clients, especially in complex or unusual liability cases, such as serial claims or product liability cases. A further focal point is advice on damage caused by managers or employees (D&O, fidelity loss). Our clients particularly appreciate our many years of experience in this field, combined with our ability to penetrate economic and technical issues deeply and to make appropriate use of them in legal advice. Of course, our activities also include the enforcement of claims in liability and coverage proceedings.

Insurance Supervision Law

We are at our clients’ disposal in particular for questions regarding the design and permissibility of distribution forms for insurance products.

Furthermore, we have many years of consulting expertise in the investment of assets of small insurance companies and pension funds. We check the admissibility of new investment products in accordance with regulatory requirements (e.g. Anlagenverordnung) and design investment guidelines. We accompany the launch and restructuring of special investment funds and negotiate the related contracts, e.g. so-called Dreier-Vereinbarung, asset manager agreements or rebate agreements. Finally, we carry out compliance audits in order to check compliance with regulatory requirements regarding the composition of assets and the internal structure of the asset management organisation, currently e.g. on the BaFin circulars R 8/2017 (derivatives circulars) and R 11/2017 (capital investment circulars).
