Marcel Kirchhartz

Marcel Kirchhartz advises financial institutions, financial services providers and companies ongoing in matters of banking supervisory law (CRR, KWG, WpHG, ZAG, MaRisk) as well as in all matters of banking law in general. Due to working experience as a bank clerk and an internship with the legal advisory Office of the Board of Managing Directors of a German bank he can look back at significant experience with regard to the inner workings of a bank. Main focuses of his consulting activity in banking supervisory law are regulatory requirements on organisation of financial institutions and services providers, the authorization issues as well as national or cross-border activities, the legal support and assessment on the development of innovative financial products as well as on compliance with distribution requirements for such products under the German Securities Trading Act. Furthermore Marcel Kirchhartz has extensive consulting experience for several years on crowdfunding/crowdlending matters (peer-to-peer-lending). Main focuses of his consulting activity in banking law in general are the assessment on contractual matters, especially in the field of financing documentation, credit transactions and credit collateral (including due diligence) as well as with regard to liability issues with regard to sales of financial products. Marcel Kirchhartz has extensive litigation experience for several years appearing in court for financial institutions and financial services providers (conflicts between financial institutions, defence against liability issues, extrajudicial dispute resolution). He publishes regularly and also acts as an expert speaker.
